Terms & Conditions

1. Introduction

These Terms & Conditions (the “Terms”) govern your access to and use of the website Freecads.com (the “Website”) and the services made available by Freecads (“Service”). The Website is owned and operated by PRSM L.P., a partnership registered in Greece (“we”, “us”, “our”). By registering an account, downloading files, or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

For the purposes of these Terms:

• “Account” means your registered user profile (free or premium) on the Website.

• “User” means any person who accesses or uses the Website or Service.

• “Contributor” means a registered user who uploads Files and participates in the contributor revenue share programme, governed by the Contributor Agreement.

• “Files” means the CAD blocks, 3 D models, drawings, vectors, textures or other design resources made available for download via the Website.

• “Premium Plan” means a paid membership tier of the Service (if any) offering additional features such as an ad-free experience or increased download limits.

• “User Content” means any content uploaded by a Contributor, including Files and metadata.

• “Licence” means the licence granted to Users under Section 7 below to download and use Files.

• “Contributor Agreement” means the separate agreement between you and us if you join as a Contributor.

• “Revenue Share Policy” means our policy describing how Contributors are paid for downloads of their Files, as published by us from time to time.

3. Access and Use of the Service

3.1 Eligibility. You must be at least 16 years old (or the age required in your country) and have capacity to enter contracts.
3.2 Registration. To access certain features you must create an Account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.3 Free and Premium access. We may offer free access and Premium Plan access. Premium access is subject to payment of fees, auto-renewal rules and cancellation rights as described in Section 5.
3.4 Acceptable use. You agree to use the Service only for lawful purposes and in accordance with these Terms.
3.5 Suspension and modification. We may suspend, modify or discontinue the Service (or parts of it) at any time without liability.

4. Contributor Programme

If you upload Files you participate in the Contributor Programme. Your rights and obligations as a Contributor are governed by the Contributor Agreement and the Revenue Share Policy. By uploading Files you accept those documents and grant us the licences described in Section 8. We reserve the right to remove or reject any upload.

5. Premium Plan, Payments and Cancellation

5.1 Fees and billing. Premium Plans are billed in advance at the specified rate. You authorise us to charge your payment method.
5.2 Auto-renewal. Unless cancelled, your Premium Plan will automatically renew at the end of the subscription period at the then-current rate.
5.3 Cancellation and refunds. You may cancel renewal at any time via your account settings. Refunds (if any) will be provided in accordance with our refund policy published on the Website.
5.4 Changes to pricing. We may change fees upon 30 days’ notice. If you do not accept the new fees you may cancel before renewal.

6. Licence to Users for Downloads

6.1 Licence grant. Subject to payment (if required) and compliance with these Terms you may download Files and use them for your internal design and professional use, including commercial projects.
6.2 Restrictions. You may not (except with Contributor’s explicit permission):

• sell, sublicense or redistribute Files as stand-alone products;

• claim ownership of the Files or remove copyright notices;

• use Files in ways that infringe any third-party intellectual property rights;

• upload or link to the Files in other download libraries.
  6.3 Responsibility. You are responsible for verifying that Files are suitable for your intended use, including compliance with local laws and third-party rights.

7. Intellectual Property Rights

7.1 Ownership. All rights, title and interest in the Website, Service, design, graphics, content (other than User Content) and software belong to us or our licensors.
7.2 Contributor’s grants. By uploading, Contributors grant us a worldwide, non-exclusive, sublicensable, royalty-free licence to host, distribute, display, and make available the Files as part of the Service.
7.3 User licence to Files. We grant you the licence under Section 6. Additional rights may be set out by the Contributor.
7.4 Trademark notices. All trademarks, service marks and logos of Freecads or others are protected and may not be used without prior written consent.

8. Prohibited Uses & Content

8.1 You agree not to:

• use the Service for illegal or fraudulent purpose;

• upload or transmit any content that is infringing, defamatory, obscene, hateful, or otherwise violates law;

• interfere with the Service (e.g., hacking, reverse engineering, distributing malicious software);

• attempt to gain unauthorised access to Accounts or systems;

• harvest or scrape data from the Service except as permitted.
  8.2 We may remove or disable access to any content that violates these Terms and may suspend or terminate your Account.

9. Termination & Suspension

9.1 We may suspend or terminate your Account or access to the Service at any time if you breach these Terms or for any other reason.
9.2 Upon termination: your licence to use Files ends; you must stop using the Service; certain provisions (for example Sections 7, 10, 11, 12, 13) survive termination.

10. Disclaimers; Limitation of Liability

10.1 The Service is provided “as is” and “as available”. We disclaim all warranties except those required by law.
10.2 To the extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, loss of profits, data loss or other damages arising out of your use of the Service.
10.3 Our total liability to you for any claim shall not exceed the amount paid by you in the 12 months preceding the claim (or €50 if you have paid none).

11. Indemnification

You agree to defend, indemnify and hold us harmless from any claim, liability, loss, damage, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of the rights of any third-party.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Greece. Any dispute will be submitted to the competent courts of Athens unless mandatory local law provides otherwise.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes we will provide 30 days’ notice via email or website banner. Your continued use of the Service after the changes becomes effective means you accept them. The “Last Updated” date will be revised.

14. Miscellaneous

14.1 Entire agreement. These Terms, together with the Privacy Policy, Contributor Agreement and Revenue Share Policy, constitute the entire agreement between you and us concerning the Service.
14.2 Assignment. We may assign our rights under these Terms to a successor entity without your consent.
14.3 Severability. If any provision is held invalid, the remainder shall remain in full force and effect.
